Moving house : when should you give notice ?
When leaving a rented property, the tenant must send a letter to the landlord informing him of his departure. However, this departure must be notified to the landlord within a notice period set by law, depending on the type of rental and the tenant’s profile.
3 months’ notice for empty rentals
The general rule for notice of departure from an empty rental property is 3 months. This means that once you know when you’ll be moving out. You should plan to send the lease termination letter at least 3 months before that date.
1 month’s notice for furnished rentals
If you are leaving a furnished rental property. You must give one month’s notice before your departure date.
When should notice be given? Notice periods reduced to 1 month
Finally, please note that in certain cases, the notice period can be reduced to just one month. Even if the property is empty. This is particularly the case if the property you are vacating is located in a “zone tendue”. In other words, an area where demand for housing outstrips supply. The notice period is also reduced in the event of a professional transfer. Whether the transfer is initiated by the employer or the tenant. Following dismissal, the notice period is also reduced to one month. But this excludes resignations and retirements. The same applies to the start of a new job, or the resumption of a new job following the loss of one. Last but not least, tenants on the RSA, people over 60 suffering from health problems, people receiving the disabled adult allowance and households obtaining social housing in place of private housing also benefit from a reduced notice period of one month.
